Terms and Conditions

1. No purchase is necessary to take part in this promotion. This promotion is open to Australian and New Zealand residents aged 18 and above, excluding any employees of the Promoter and their families, agents and anyone else connected with this promotion. - To enter the monthly draw, just email spotenquiries@au.penguingroup.com a written entry to tell us in 25 words or less why you love your best friend (Entry).
2. The monthly competitions open on the 1st of each month 2011, starting on 1 July 2011 and closes at 5pm AEST on the last Friday of the month being as follows:
   
   - July monthly draw opens 1 July 2011 and closes 5pm AEST Friday 29 July 2011
   - August monthly draw opens 1 August 2011 and closes 5pm AEST Friday 26 August 2011
   - September monthly draw opens 1 September 2011 and closes 5pm AEST Friday 30 September 2011
   - October monthly draw opens 1 October 2011 and closes 5pm AEST Friday 28 October 2011
   - November monthly draw opens 1 November 2011 and closes 5pm AEST Friday 25 November 2011
   - December monthly draw opens 1 December 2011 and closes 5pm AEST Friday 30 December 2011
   
   
3. Entry to the final draw to win the major prize opens 1 July 2011 and closes at 5pm AEST Tuesday 31 January 2012. Entry to a monthly draw automatically includes entry to the final draw to win the major prize on 31 January 2012.
4. You may enter each monthly draw once only. No entrant may win more than one monthly prize. The Promoter, Penguin Group (Australia) accepts no liability for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems and/or traffic congestion on telephone networks or lines that cause late or delayed entries, or for any lost and/or misdirected entries not received by the closing date.
5. Monthly Entries will be judged for ONE monthly prize winner at 10am AEST on the Monday following the monthly competition closing date. The final draw for ONE major prize will be judged on Tuesday 31 January 2012. All prizes will be judged at Penguin Group (Australia), 250 Camberwell Road, Camberwell, Victoria, 3124.
6. The winner will be notified by phone/email. You must claim your prize within 21 days after we notify you. Any unclaimed monthly prize will be awarded to the entrant whose Entry was judged to be the second best after 21 days.
7. Your prize will be sent to you within 28 working days after claiming the prize.
8. Chance plays no part in determining the winner. Entries will be judged in regard to written skill and creativity of reply.
9. Do not send any creative materials apart from your Entry, as no material can or will be returned.
10. By entering this competition each entrant confirms that his/her Entry is entirely their own/original work. If any Entry makes use of any third party materials, then it is the entrant's responsibility to have these been fully cleared by the third party owner, unless they are no longer protected by copyright or other intellectual property rights. Entrants will indemnify and keep the Promoter harmless from any claims in relation to their Entry that the Entry infringes the personal or proprietary right of any other person or third party.
11. By submitting an Entry, each entrant grants to the Promoter a perpetual, royalty-free, non-exclusive licence to reproduce, edit, publish, translate, modify, adapt, communicate to the public, make available and distribute the work contained in the Entry for any purpose throughout the world in any media now known or hereafter invented. To this end, each entrant hereby unconditionally and irrevocably consents to any of the foregoing acts being done with respect to their Entry, without their prior express consent and/or without attribution of authorship,. Each entrant also undertakes to complete any necessary documentation to formalise the licence. If you do not want to grant us these rights, please do not submit materials to us.
12. All Entries become the property of Penguin Group (Australia).
13. The judge's decision is final and no correspondence will be entertained.
14. Each monthly prize winner will receive Spot books to the retail value of AUD50 - a total prize value per month of AUD50.
15. There is 1 prize to be won in the final, major prize draws: (a) one major first prize winner will receive an Apple iPad XGB valued at $579. (The iPad will not include any accessories or applications); The total value of final draw prize is estimated at RRP AUD579.00 . Total prize pool is estimated at RRP AUD879.00.
16. Prizes are not transferable and not redeemable for cash or any other goods or services. If for any reason the promotion is not capable of running as planned, the Promoter reserves the right in its sole discretion (subject always to any direction given by a relevant gaming or lotteries authority) to cancel, terminate, modify or suspend the promotion. The Promoter may in its sole discretion disqualify any individual who tampers or interferes with the participation process.
17. The personal information you provide to Penguin is collected for the purpose of notifying the participants and for Penguin's direct marketing . Access to your personal information held by Penguin can be arranged by contacting Penguin's Privacy Officer.
18. Each participant agrees to be bound by these terms and conditions. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including, without limitation, liability for negligence), in respect of any loss or damage; whether direct, indirect, special or consequential, arising in any way in relation to the Promotion.
19. These terms and conditions are governed by the laws of the State of Victoria, Australia.
